Acceptable Use Policy

1. General Provisions

The Services provided by Sunetix™ (“Company”) may only be used for lawful purposes.
You, as the Client, are responsible for ensuring that both you and your end users comply with applicable laws, rules, and regulations concerning the use of the Company’s Services. The Company reserves the right to suspend or terminate services or remove content that violates these provisions.

2. Prohibited Content and Activities

The following types of content and/or activities are strictly prohibited, and the Client shall not use the Services to store, transmit, or make available such content or activities. In the event of these violation Sunetix reserves the right to suspend or terminate the Clients’s service permanently without notice.
If the service was suspended or terminated due to the violation of this policy, the Client is not entitled
to any form of refund, and the Company will reject such requests. The Company disclaims any responsibility
for any content posted by the Client that violates this Policy.
The Company is not liable for backing up content that breaches this Policy.

2.1. Copyright Violations

The distribution or storage of pirated software, unauthorized copyrighted materials,
or links to pirated content is prohibited. The Client must ensure that they
have the necessary rights to distribute any content they host.

2.2. Criminal and Abusive Materials

The Client is strictly prohibited from hosting, distributing, or making accessible any content that includes,
promotes, or facilitates the following: content that involves child sexual abuse material (CSAM),
including computer-generated depictions of minors; content depicting or involving pornography, including, but not limited to, zoophilia, rape, sexual assault, disfigurement, or extreme violence; content that incites, glorifies, or promotes terrorism, war crimes, hate speech, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, or any other form of discrimination; content that is deemed objectively objectionable by the Company, at its sole discretion, based on considerations of public morality, human dignity, or any other factors that violate legal, ethical, or social standards.
Such content will be removed immediately upon discovery, and the Company reserves the right to suspend or terminate the Client’s services without notice in the event of such violations. The Client is solely responsible for ensuring that no materials they host or distribute fall under these prohibitions.

2.3. Malicious Code and Materials

The Client is strictly prohibited from hosting, distributing, or making accessible
any malicious code including, but not limited to, malware, viruses, trojans, worms, scripts or malicious code designed to harm systems or data. Distributing tools or services enabling spam, phishing, or illegal activities is forbidden. the Company reserves the right to suspend or terminate the Client’s services
without notice in the event of such violations. The Client is solely responsible
for ensuring that no materials they host or distribute fall under these prohibitions.

2.4. Malicious and fraudulent activity

Malicious and fraudulent activity is strictly forbidden.
Sunetix reserves the right to suspend or terminate the Client’s services without notice in the event of such violations.
The Client is solely responsible for ensuring that no prohibited activity is conducted using the services.
The prohibited activity includes, but not limited to:

  • Phishing
  • Mail spoofing
  • Spam
  • Unauthorized mass messaging
  • Scam
  • Carding

2.5. Pornography distribution

Using services to store, distribute or advertise the pornography materials is forbidden.
In the event of this violation, the Company reserves the right to suspend the Client’s services without notice.

2.6. Network and Infrastructure Abuse

Any activity that disrupts or threatens the integrity of the Company’s network or infrastructure,
including but not limited to, DDoS attacks, port scanning, hacking attempts,
and unauthorized access to third-party systems, is prohibited.
Activity that interferes or disrupts the third-party services or infrastructure is forbidden.
The Client may not use the Services for activities that can harm or interfere with other users, networks, or systems.

2.7. Illegal Commerce

The use of the Services to facilitate illegal activities such as the sale or distribution of controlled substances,
prescription drugs, or the use of Services to enable illicit transactions on darknet marketplaces is strictly prohibited.

2.8 Data Harvesting for Abuse

Using the services to collect, store or distribute any data, including, but not limited to personal data, emails,
addresses to facilitate spamming or phishing is forbidden

2.9 Other forbidden activities

  • Activities designed to avoid payment obligations for the Services.
  • Activities that may cause corporate, civil or administrative liability for the Client or the Company
  • Activities that disrupt, provide unauthorized access or interfere in any way with the Company’s or third-party’s equipment,
    infrastructure, resources, data or code.

3. Client Responsibilities

The Client assumes full responsibility for their actions and those of their end users in connection with the Services provided.
The Client is required to ensure compliance with this Policy and may be held liable for any breach,
including indemnifying the Company against damages resulting from violations. For corporate Clients,
an authorized representative must provide proof of authority when requested. Non-compliance may result in the suspension or termination of services.

4. Enforcement Measures

The Company reserves the right to take immediate action, without prior notice,
in the event of any breach of this Policy, including but not limited to:

  • Suspending or terminating accounts
  • Permanently deleting illegal content without retaining backups
  • Disclosing relevant data to law enforcement or regulatory authorities
  • Restricting network access during ongoing attacks, such as DDoS

5. Anti-Spam Policy

Unsolicited bulk messaging (spam) is strictly prohibited.
The Client must ensure that they obtain explicit consent from recipients before sending any promotional messages.
Measures must be in place to prevent third parties from using the Services for spamming purposes.
Violations will result in the blacklisting of associated IP addresses or domains.
The Client is solely responsible for preventing the third-party spam.

6. Content Moderation and Abuse Handling

6.1. Submitting Complaints

Abuse reports must be sent to abuse@sunetix.host in Ukrainian or English and must include the following details:

  • Full details of the sender or authorized representative
  • A description of the violation with timestamps
  • Documented evidence such as screenshots, logs with timestamps or court orders

6.2. Response Protocol

Upon receiving a valid abuse complaint, the Company will respond by acknowledging the complaint within 24 hours. Content will be removed or restricted within 48 hours if the complaint is validated.
Both the complainant and the Client will be notified once the matter is resolved.

6.3. Copyright Claims

Notices related to copyright infringement must be submitted exclusively by Ukrainian-licensed attorneys.
The Client will have 72 hours to contest any copyright claim before the content is permanently removed.

7. Disclaimers

The Company does not monitor or pre-screen content hosted by Clients but reserves the right to take action as necessary to comply with the law or protect its network and services. The Company is not responsible for any damages resulting from the Client’s failure to secure their data or for any indirect damages arising from third-party attacks.
